Ans: Peninsular and Oriental Steam Navigation Co. v. Secretary of State for India, 1861 .
Few workers were crossing the road while rod in their hands. They listened the sound of horses and got scared . They dropped the rod on the road and walked away.  The horses met with an accident due to rod and died on the spot. The company put a case against secretary of India and it was held that the secretary of India would be liable for the negligence of his workers.
